Terms and conditions.
The terms you agree to when you order from Nirvana Musicals — how a contract is formed, what you pay, and what happens if something goes wrong.
About these terms
These terms apply to every order placed through nirvanamusicals.com and to purchases made in our shop. By placing an order you accept them, so please read them before you buy.
If you are buying as a consumer, nothing here removes the rights you have by law. If you are buying on behalf of a business, the business-to-business terms further down apply instead where they differ.
Ordering
Everything on the site is an invitation to buy, not an offer. Your order is the offer, and a contract only exists once we confirm it — by email for online orders, or at the till for purchases in store.
We may decline an order if an item turns out to be out of stock, if a price or description was plainly wrong, or if we cannot verify payment or delivery details. If we decline, we refund anything you have already paid in full.
Prices and payment
Prices are shown in the currency selected on the site and are the amounts you pay. Where a tax applies to your order it is included unless the checkout says otherwise. Delivery is charged separately unless your order qualifies for free delivery, and the checkout shows the delivery charge before you confirm.
We accept the payment methods listed at checkout. For cash on delivery, the amount shown at checkout is collected by the courier — please have it ready, as drivers cannot take card payment at the door.
Delivery
Delivery timescales are estimates, not guarantees, and they run from the working day after we confirm your order. Risk in the goods passes to you when they are delivered to the address you gave us.
If nobody is available to take delivery, the courier may leave a card or return the parcel to a local depot. Parcels that are returned to us because delivery could not be completed are refunded minus the original delivery cost.
Your right to cancel
As a consumer you may cancel an online order within 14 days of receiving it, without giving a reason, and return the goods to us. Our own returns window is longer than the statutory minimum — see the returns policy for the current period and the conditions.
Cancellation rights do not apply to items that are made to your specification, to custom-built instruments, or to goods that have been personalised at your request.
If something is wrong with your order
Goods must be of satisfactory quality, fit for purpose and as described. If they are not, you are entitled to a remedy under consumer law, and our warranty and repairs page explains how to arrange one.
Please report damage or a short delivery within 48 hours of receipt so we can deal with the courier while the trail is still fresh.
Setups, modifications and servicing
Instruments we set up before dispatch are adjusted to our standard specification. If you ask us to modify an instrument — a different nut, a pickup swap, a refret — the work is carried out at your instruction and is not returnable on the grounds that you do not like the result.
Work carried out by a third party after you receive an instrument is outside our control and may affect your warranty with the manufacturer.
Our liability
We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Beyond that, our liability for any single order is limited to the amount you paid for it, and we are not liable for indirect or consequential losses such as lost earnings or lost opportunity.
Changes and governing law
We may update these terms from time to time; the version that applies to your order is the one published when you place it.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute. Our registered details are available on request.
